Senator Bato Dela Rosa could soon join ex-president Rodrigo Duterte in the crimes against humanity trial before the International Criminal Court despite his evasion of an ICC arrest warrant, a legal expert said.
Atty Ruben Carranza, International Center for Transitional Justice senior expert, said the ICC is not dependent on the Philippine Supreme Court’s decision on whether or not the ICC warrant for Sen. Bato Dela Rosa is valid.
“Yung ICC will not really depend on a Philippine Supreme Court decision on whether or not tama ba na hulihin si de la Rosa based on the ICC warrant. As far as the ICC is concerned, its warrant is valid and it expects cooperation from the Philippines including the same Supreme Court na sinabi sa Cayetano v. Pangilinan ruling na may obligation ang Pilipinas na makipagtulungan to cooperate with the ICC kahit nag-withdraw na," he told DZMM.
“Malinaw na malinaw yan na medyo nilalabo lang ni Dela Rosa at mga kaalyado niya yung ruling na kahit nag-withdraw na ang Pilipinas ICC, sabi ng Supreme Court ng Pilipinas mismo may obligation pa rin ng Pilipinas na makipagtulungan. So obligation ng Pilipinas na hulihin si de la Rosa, gamitin yung arrest warrant ng ICC.”
Carranza said the ICC Prosecutor’s ongoing investigation on Duterte’s “co-perpetrators” could mean they will be added to the case.
“‘Yung ongoing investigation kasama dyan ‘yung kaso laban kay Dela Rosa at dun sa pito pang tao na pinangalanan ng ICC prosecutor sa kanyang charges. So i-disclose yan ng prosecutor na may hinuhuli kaming tao, may mga huhulihin pa kami, at posibleng baguhin, idagdag sila sa kaso ito laban kay Duterte o magbubukas ng bagong kaso. Later on pa lang pagpapasyahan if there's going to be a joint trial or a separate trial,” he said.
In the interview, Carranza said it is unlikely that the ICC will pursue obstruction of justice charges against those who helped Bato escape.
He noted the same has also happened in other ICC cases but during the trial stage.
“Ang tawag dyan conduct that interferes with the administration of justice, ICC, hindi siya basta-basta magbubukas ng kaso tungkol dyan…In theory pwedeng magbukas ng ganyan kaso sa ICC yung ICC prosecutor pero makakapag-complicate lang yan sa trabaho niya. Kakain ng mga resources at oras,” he said.
